3. You must have an online presence where your work can be viewed: website, blog, etc.
4. You must be willing to be an Active Member of DAG. Participate in the Forum, Groups, and Activities.
5. You must be 18 years of age.
6. Read the Terms of Service listed below.

To ensure that DAG remains a safe and enjoyable web site for all visitors we require that anyone using our web site agree and abide to the "Terms of Service" outlined below:
DAG provides its service to you subject to the following Terms of Service which may be updated by us without notice to you.
In addition, when using particular DAG services, you shall be subject to any posted guidelines or rules applicable to such services.
Membership requirements are subject to change.
The Dark Artists Guilds "Terms of Service"
GENERAL INFORMATION
You agree and understand that the Dark Artists Guild hereby known as (DAG) represents only Dark Art Works. Members are not allowed to have any manufactured wares/items listed.
You must be 18 years and older to use this site.
We reserve the right to modify or terminate the Services for any reason, without notice at any time. We may, but have no obligation to, remove Image content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violate any party's intellectual property or these Terms of Use.
IMAGES
You are solely responsible for uploading only images and descriptions of creations that you have handmade relative to the examples and genre’s that DAG Represents. DAG at its sole discretion will determine image relevancy as it applies to the examples and genre’s and will delete images that do not apply.

If you create Halloween, Dark Fantasy, Dark Side of Fae, Steam Punk, and Bio-Mechanical;
Please be aware that Dag is looking for the darker-darkest versions of these genres
We do not accept: Pornographic Images/Material and Realistic Depictions of Death:
You are solely responsible for any graphics, data, text, information, screen names, photos, profiles, and links that you submit, post, and display on the DAG site. You attest that you are the rightful owner of those images & descriptions and you have legal authority to represent those images and names/text.
You agree and understand that all transactions that transpire by and between you and buyers are your responsibility. DAG has no dealings with the transactions that occur by and between you and your Buyer resulting from your Dark Artists Guild account.
You are responsible for keeping your password secure.
You must not abuse, harass, threaten, impersonate or intimidate other DAG users/members.
You may not use the DAG site for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
You agree to not submit unwanted email to any DAG members ("Spam"). Including soliciting to join other groups.
You must not, in the use of DAG, violate any laws in your jurisdiction.
We reserve the right to refuse service to anyone for any reason at any time.
Your account is intended for personal use, you must not share it with other guests/sellers/members. Your account will be terminated if it is used for hosting graphic elements of web page designs, icons, forum avatars, badges and other non-photographic elements on external websites.
We claim no intellectual property rights over the material you provide to the DAG site. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your images.
After 60-days of no activity on the site, your account will be purged from the system. However, by uploading images and item description content to DAG, you agree to allow other DAG users to view them and you agree to allow DAG to display and store them.
Members must not add other software nor modify, disturb, alter, remove, nor otherwise tamper with any portion of the Software;
PAYMENT INCREASES
Payment Terms. Increases in any and all programming, license, copyright, retransmission and/or other costs, charges, fees or amounts including, without limitation, taxes and any and all other governmental fees, charges and/or other amounts, shall not be deemed to be included in the Monthly Service Fees or limited by any provision in this Agreement, and may be passed on to Customer at any time when such costs are incurred by, assessed or required of DAG. DAG may increase the Monthly Service Fees from time to time upon thirty (30) days' prior written notice to Customer.
Provision of Service: DAG may, in its sole discretion, from time to time, rearrange, delete, add or otherwise change packaging and Services contained in DAG basic structure or other Services provided pursuant to this Agreement. Customer acknowledges that DAG has the right at any time to upgrade, change or enhance the website without notice and to substitute software that DAG deems to be comparable.
Restrictions: Customer shall not and shall not authorize or permit any person or persons to (i) copy, record, dub, duplicate, alter, make or manufacture any software or other products of the Services (or any part thereof); (ii) transmit the Services (or any part thereof) by any computer or electronic transmission or by any other means or use the Services (or any part thereof) outside the Service Location. Customer acknowledges that such duplication, reproduction or transmission may subject Customer to criminal penalties and/or civil liability and damages under applicable copyright and/or trademark laws. Customer shall not, and shall not authorize or permit any other person to (i) charge a cover charge or admission fee to any Service Location(s) at the time the Services (or any part thereof) are being performed or are to be performed. If Customer fails to abide by these restrictions, Customer accepts liability for any and all claims made against Customer or DAG due to any unauthorized commercial exhibition and Customer agrees to indemnify and hold DAG harmless from any damages, loss, cost, liability, or expense, including reasonable attorneys' fees arising from a breach of these restrictions.
LIMITATION OF LIABILITY
Limited Warranty: At all times during the Service Period, DAG warrants that it will use commercially reasonable efforts in keeping with industry standards to cause the Services to be available to the Customer.
Damage, Loss or Destruction of Software Files and/or Data: Customer agrees that Customer uses the Services supplied by DAG at its sole risk. DAG does not manufacture the Equipment, and the Equipment is provided by DAG in good faith on an "as is basis" without warranties of any kind. DAG assumes no responsibility whatsoever for any damage to or loss or destruction of any of Customer's hardware, software, files, data or peripherals which may result from Customer's use of any Service or from the installation, maintenance or removal of any Service, Network, or related Equipment or software. DAG does not warrant that data or files sent by or to Customer will be transmitted in uncorrupted form or within a reasonable period of time. Customer agrees that DAG shall not be liable for any inconvenience, loss, liability or damage resulting from any failure or interruption of Services, directly or indirectly caused by circumstances beyond DAG's control, including but not limited to denial of use of poles or other facilities of a utility company, labor disputes, acts of war, or terrorism, criminal, illegal or unlawful acts natural causes, mechanical or power failures, or any order, law or ordinance in any way restricting the operation of the Services.
INDEMNIFICATION AND CUSTOMER OWNERSHIP.
In addition to its specific indemnification responsibilities set forth elsewhere in this Service Agreement and as permissible under applicable law, Customer agrees, at its own expense, to indemnify defend and hold harmless DAG and its directors, employees, representatives, officers and agents, (the "Indemnified Parties") against any and all claims, liabilities, lawsuits, damages, losses, judgments, costs, fees and expenses incurred by DAG Indemnified Parties, including but not limited to, reasonable attorneys' fees and costs incurred by DAG Indemnified Parties in enforcing its rights under this Service Agreement, to the full extent that such arise from Customer's misrepresentation with regard to or noncompliance with the terms of this Service Agreement, Customer's failure to comply with applicable law, and/or Customer's negligence or willful misconduct. DAG Indemnified Parties shall have the right but not the obligation to participate in the defense of the claim at Customer's cost and Customer agrees to cooperate with Dark Artists Guild Indemnified Parties in such case.
Customer understands that the upload of images, logos, websites, and other electronic locations, is the sole ownership of the Customer. DAG does not own, operate, or subscribe to the links that the Customer provides. Customer has uploaded images, logos, and other electronically transmissions, releasing DAG from applicable patent laws and copyright laws. Customer will only upload images and logos that are legally owned by the Customer. Any uploads of images or other electronically transmitted content that are not owned by the Customer is a breech of this Agreement; DAG can and will immediately terminate this Agreement without notice or refunds.
Customer shall not use or permit third parties to use the Services in any manner that violates applicable law or causes DAG to violate applicable law. Both parties shall comply with all applicable laws and regulations when carrying out their respective duties hereunder.
DAG treats private communications on or through its Network or using any Service as confidential and does not access, use or disclose the contents of private communications, except in limited circumstances and as permitted by law.
OWNERSHIP
Customer understands and agrees that notwithstanding any other provision contained herein to the contrary, all Equipment and materials installed or provided by Dark Artists Guild are and shall always remain the property of DAG.
Violation of any of these agreements will result in the termination of your DAG account. While DAG prohibits such conduct and content on its site, you understand and agree that DAG cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the DAG service at your own risk.
You must read, agree with and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of DAG.
We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you by email. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
DAG may amend this Agreement at any time by posting the amended terms on the Site. This Agreement is effective upon acceptance in registration for new registering users, and is otherwise effective on November 01, 2008 for all users.
Violation of any of these agreements may result in the termination of your DAG access. Abusive users and robots may be blocked from the DAG web site.
